By accessing or using our Site and Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you may not use our Site or Services.

1. General conditions and your account

• Eligibility: To use our Services, you must be at least 18 years old and capable of forming a binding contract.

• Account responsibility: If you create an account, you are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

• Accuracy of information: You represent and warrant that all information you provide to us is truthful and accurate. You are responsible for maintaining the accuracy of this information.

2. Custom orders and proofing

• Customization process: You are responsible for providing all necessary information, including accurate specifications, artwork, and designs for your custom order.

• Design approval: For each custom order, we will provide you with a digital mock-up or "proof" for your review and approval. You must carefully review this proof for any errors in design, spelling, colors, and placement.

• Final approval: Production will not begin until we receive your written approval of the proof. By approving the proof, you accept full responsibility for any errors present in the final product. We are not liable for any discrepancies found after approval.

• No modifications after approval: Once you approve the final proof, your order is considered final, and no further modifications can be made.

3. Intellectual property rights

• Your content: You represent and warrant that any text, images, designs, or other materials you submit to us for customization ("Your Content") are your original creations or that you have the necessary permissions, rights, and licenses to use and authorize us to use Your Content for your custom order.

• Indemnification for infringement: You agree to indemnify, defend, and hold harmless

   from any and all claims, liabilities, costs, and expenses (including legal fees) arising from any third-party claim of intellectual property infringement related to Your Content.

• Our right to refuse: We reserve the right to refuse any order containing content that we, in our sole discretion, deem inappropriate, illegal, or that we believe may infringe upon the intellectual property rights of a third party.

• License to Your Content: By submitting Your Content, you grant 

  Rising Tide Customs, LLC

   a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, and display Your Content for the sole purpose of fulfilling your specific order.

• Our content: All content on the Site, including our logo, designs, and text, is the exclusive property of 

  Rising Tide Customs, LLC

   and is protected by intellectual property laws. You may not use any of our content without our express written permission.

4. Payment, shipping, and cancellations

• Payment: Full payment is required at the time of order placement.

• Shipping: We provide estimated production and shipping times. These are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers or other factors beyond our control.

• Cancellations: You may cancel a custom order for a full refund within 24 hours of placing the order. After this 24-hour window, the order is considered confirmed, and no cancellations will be accepted.

5. Limitation of liability and warranties

• Warranty disclaimer: Our Services and products are provided "as is" and "as available," without any warranties of any kind, either express or implied.

• Exclusion of damages: To the fullest extent permitted by law,

   will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or products.

• Cap on liability: In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you paid us for the specific custom product in question.

6. Dispute resolution and governing law

• Governing law: These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles.

• Binding arbitration: Any dispute or claim arising from these Terms will be resolved through final and binding arbitration in South Carolina, rather than in court. You and Rising Tide Customs, LLC are waiving the right to a jury trial.

• Class action waiver: You agree that any arbitration will be conducted solely on an individual basis and not as a class, consolidated, or representative action.

7. Miscellaneous

• Entire agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and
